<b>Personal Data Processing Information Clause.</b> <br> Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation GDPR), ITEO S.A. hereby informs that: 1. Data Controller The controller of your personal data is ITEO S.A. with its registered office in Katowice, ul. Gawronów 6, 40-527 Katowice, e-mail: rodo@iteo.com, tel. +48 327003880. 2. Legal Basis and Purposes of Processing The processing of your personal data will be carried out on the following bases: - To conduct the recruitment process, based on the employer's entitlement resulting from Article 22¹ of the Polish Labor Code and within the scope of: name and surname, date of birth, place of residence, correspondence address, education, and previous employment history. The legal basis for processing the aforementioned personal data is a legal obligation (Article 6(1)(c) of the GDPR); - To conclude and perform a contract with the Controller within the scope of: name and surname, date of birth, place of residence, correspondence address, education, and previous employment history. The legal basis for processing the aforementioned personal data is the necessity for the performance of a contract to which the data subject is party, or to take steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) of the GDPR); - To conduct the recruitment process, based on your consent to the processing of your personal data, i.e., personal data other than those specified in the point above, provided in the CV, application form, cover letter, and other documents. The basis for processing is the aforementioned consent (Article 6(1)(a) of the GDPR); - To pursue the legitimate interest of the Controller regarding the data obtained from you during the recruitment process in connection with verifying your skills and abilities required for the position specified in the job advertisement. The basis for processing this data is our legitimate interest (Article 6(1)(f) of the GDPR); - To conduct future recruitment processes, based on your consent to the processing of personal data provided in the CV, application form, cover letter, and other documents. The basis for processing is this consent (Article 6(1)(a) of the GDPR) 3. Data Retention Period Your personal data will be processed for the period necessary to conduct the recruitment process, unless you consent to joining our Talent Pool in which case they will be stored for a period of 24 months from the date of granting consent. 4. Data Subject Rights Under the rules set out by generally applicable law, you have the right to: - access your personal data, - rectify and erase your personal data, - restrict the processing of personal data, - data portability, - object to the processing of your personal data. 5. Right to Lodge a Complaint You have the right to lodge a complaint with the supervisory authority the President of the Personal Data Protection Office (PUODO), if you suspect that your data is being processed in violation of the law. 6. Voluntary Provision of Data Providing your personal data is voluntary, yet necessary for your participation in the recruitment process and for the possibility of concluding and performing a future Employment Contract or Cooperation Agreement. The consequence of failing to provide personal data will be the inability to participate in the recruitment process. 7. Data Recipients Your personal data will be transferred to entities providing support services to the Controller. Furthermore, data will be transferred to third parties only in the performance of an obligation resulting from generally applicable provisions of law. 8. Automated Decision-Making and Profiling Your personal data will not be processed in an automated manner, including profiling. 9. Withdrawal of Consent You have the right to withdraw your consent to the processing of personal data at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. A statement on the withdrawal of consent to the processing of personal data can be sent to the addresses indicated in point 1.
